Museums Advocacy Day Takes Place in March

The American Association of Museums (AAM) is organizing Museums Advocacy Day 2010, taking place March 22–23 in Washington, DC, and CAA invites your participation. This event is your chance to receive advocacy and policy training and then take the case to Capitol Hill alongside fellow advocates from your state and congressional district.

AAM is working with sponsoring organizations, which include CAA, to develop the legislative agenda for this year’s event. Likely issues will include federal funding for museums, museums and federal education policy, and charitable giving issues affecting museums.

The entire museum field is welcome to participate: staff, volunteers, trustees, students, or even museum enthusiasts. Museums Advocacy Day is the ideal chance for new and seasoned advocates to network with museum professionals from their state and meet with congressional offices.

Registration

Individual museum professionals, supporters, and trustees may register online. National, regional, and state organizations that would like to register as partnering organizations and individuals who prefer to complete a paper registration may use the Museums Advocacy Day 2010 Registration Form.

Participants are asked to cover the cost of their meals and materials: $75. This amount includes: two breakfasts, one lunch, one evening reception, and all training materials and supplies.

We are currently arranging affordable hotel options for participants. Please check back for updated information in the coming weeks about participating hotels.

Tentative Schedule

March 22 will be a critical day of advocacy and policy training, to be held at the National Building Museum, featuring:

  • A briefing on the museum field’s legislative agenda
  • Tips on meeting with elected officials and the stats you need to make your case
  • Instruction on how to participate in year-round advocacy and engage your elected officials in the ongoing work of your museum
  • Networking with advocates from your state on the following day’s Capitol Hill visits
  • An evening reception, with members of Congress and staff invited

On March 23, we will take our message to Capitol Hill. Advocates will gather in groups by state and congressional districts to make coordinated visits to House and Senate offices to make the case for increased federal support for museums.

Today in Inside Higher Ed, Scott Jaschik reports on recent work of a task force, comprising representatives from seven national and international organizations, that is raising awareness of the value of university and college art museums and galleries in light of recent events involving attempts by schools to sell work from their collections.

In “Avoiding the Next Brandeis,” Jaschik talks to the task-force cochair David Alan Robertson, director of Northwestern University’s Mary and Leigh Block Museum of Art, who is “trying to impress upon [regional higher-education accrediting agencies] that museums shouldn’t be viewed as extras, but as ‘teaching institutions and research institutions.’” Jaschik continues, “Another strategy being discussed is encouraging colleges to define the financial exigency plans—or what they would do in a severe financial crisis—and to make the case that museums should not be the first institutions to be closed.”

Lyndel King, task-force cochair and director and chief curator of the Frederick R. Weisman Art Museum at the University of Minnesota, Twin Cities, tells the reporter that “we need to educate college administrators and governing boards that disposing of their collections can’t be a way to fill the coffers or seen as an easy way to bring in money.”

The task force comprises representatives from CAA, the American Association of Museums, the Association of Art Museum Directors, the Association of College and University Museums and Galleries, the International Council of Museums, the Samuel H. Kress Foundation, and the Association of Art Museum Curators. The next meeting of the task force will take place on January 9, 2010, in Sarasota, Florida, in conjunction with the midwinter gathering of the Association of Art Museum Directors.

The task force had planned to include all signatories in the ad, but the list has exceeded 2,200 names and institutional affiliations—too many to include in print.

A report issued by a Brandeis University committee recommends that the school’s Rose Art Museum remain open, but the future of the collection of modern and contemporary art is still in doubt.

In the Boston Globe, Tracy Jan writes that the committee, comprising teachers, students, and university trustees and officials, also suggests better integration between the museum and academic departments, which include not just visual art but also math and science. In addition, a full-time director, who would also teach, and an education director should be hired.

This past summer several members of the Rose Art Museum’s board of overseers filed a lawsuit in Massachusetts in an attempt to prevent Brandeis from selling the art collection. Last week the university filed to dismiss that lawsuit, according to Greg Cook of the New England Journal of Aesthetic Research. An October 13 hearing date has been set.

Fractional Gifts Legislation Introduced in the Senate

An untitled bill introduced last week in the US Senate may loosen recent government restrictions on fractional gifts of works of art to museums, reports Shelly Banjo of the Wall Street Journal. Senator Charles Schumer (D-NY), whose state contains many important art museums, patrons, and philanthropists, is sponsoring S 1605, which would reform the rules regulating fractional charitable donations of tangible personal property.

Fractional gifts—which allow Americans to give partial ownership rights of an artwork to a museum or charitable organization and take an income-tax deduction for the donated portion of its value—were common practice in the museum world until 2006, when provisions put into the Pension Protection Act of 2006 by Senator Charles E. Grassley (R-IA) made partial gifts less attractive for donors. (Namely, that work must be fully donated within ten years of the initial fractional gift, and that the value of the artwork is capped when the first gift is made.) Since then, museums noticed that the practice of fractional gifts has nearly disappeared.

A Tennessee Court of Appeals ruled on Tuesday that the Georgia O’Keeffe Museum in Santa Fe, New Mexico, may not intervene in the sale of artworks that the late artist donated to Fisk University. For more than three years the cash-strapped Nashville school, which owns a substantial bequest that includes O’Keeffe’s famous Radiator Building – Night, New York (1927) and Marsden Hartley’s Painting No. 3 (1913), has wanted to sell those two paintings to—and share the display of many other works in the prized collection with—the Crystal Bridges Museum in Bentonville, Arkansas.

Several university art museums or their school administrations have recently sold, or have attempted to sell, artworks and objects in their collections to offset operating costs. In response to this, CAA has joined a task force supporting the educational importance of preserving collections at university museums and galleries. The task force—which includes representatives from the American Association of Museums, the Association of Art Museum Directors, the Association of College and University Museums and Galleries, and the Samuel H. Kress Foundation—has established a two-pronged effort: 1) to recognize museums as integral educational resources in the university accreditation process; and 2) to heighten public awareness of the educational value of art museum collections.

Members of the task force are meeting with accreditation organizations throughout the country to enlist their support for the recognition of art museums as integral educational resources.

A petition has been prepared that reaffirms the integrity and value of university and college museums.

Rose Board Responds to Museum Crisis

The board of overseers at the Rose Art Museum at Brandeis University released a statement yesterday, found here and here, to counter provost Marty Wyngaarden Krauss’s missive from last week about keeping the building open to art exhibitions beyond this summer. Since late January, when the university first announced plans to close the museum and sell its collections, the school administration has backpedaled several times, claiming to transform the museum into an art study and exhibition center (which it already is), to not sell the entire collection, and to continue hosting exhibitions. To which the board responds:

In her letter, Krauss attempted to clarify future plans for the Rose Art Museum once the University closes it on June 30, 2009. Despite the existence of the current Board of Overseers for the museum, Brandeis has named a new committee to “explore future options for the Rose.” In addition, the current position of museum director will be eliminated. According to Jon Lee, chair of the Rose Art Museum’s Board of Overseers, “Without a director or curator, the Rose cannot continue to function as a museum under any meaningful definition. Since the University’s announcement on January 26, 2009 that it would close the museum, membership and Rose Overseer dues, and all donations have ceased or been asked to be returned. This amounts to more than $2.5 million.”

“When the Rose family originally founded the Rose Art Museum, they were very clear about its mission and the integral role it would play as a part of the Brandeis community,” said Meryl Rose, a member of the Rose Art Museum’s Board of Overseers and a relative to the original museum founders. “A museum with a collection and reputation such as the Rose needs a director, and while Krauss’s letter states that the collection will be cared for, it does not erase the fact that the Rose as we know it will cease to exist under the administration’s current plans. The administration is carrying out an elaborate charade, the first step of which is to turn the Rose from a true museum as its founders intended, into something quite different….”

Again, the full statement can be found here and here. Richard Lacayo, art and architectural critic for Time, wrote about Brandeis’s announcement last week and quotes Rose director Michael Rush:

So long as the Rose remains open as a museum, it remains subject to the ethical guidelines of American museum groups that do what they can to discourage the kind of emergency sales that Brandeis is contemplating. But I spoke later with Michael Rush, the director of the Rose, who will soon be gone, along with several other significant Rose staffers. He was skeptical about what the university was doing. “They’re talking about keeping the Rose open,” he said. “But there’s no director, no curator, no education director, no funding stream and no program.”

An update to Lacayo’s report is a message from Jon Lee, Rose board chairman, which notes that Massachusett’s Attorney General office is watching developments closely. Relatedly, Art in America has published an interview with Meryl Rose, in which potential legal action is briefly discussed.

The situation at Brandeis is one of many taking place concerning unusual uses of restricted endowments and related funding. In his article “New Unrest on Campus as Donors Rebel,” John Hechinger of the Wall Street Journal writes, “As schools struggle more than they have in decades to fund their core operations, many are looking to a rich pool of so-called restricted gifts—held in endowments whose donors often provide firm instructions on how their money should be spent.”

The Artist-Museum Partnership Act of 2009, legislation introduced in both houses of Congress, would allow a fair-market-value tax deduction for charitable contributions of literary, musical, artistic, or scholarly compositions to collecting institutions such as museums, libraries, and archives. At present, a donating artist, writer, or composer can only deduct the cost of materials used to create the work, which is not a fair incentive to donate and also hurts the missions of public and nonprofit institutions nationwide to increase public access to these unique creations.

The sponsors of the bill—Senators Patrick Leahy (D-VT) and Robert Bennett (R-UT) for S 405 and Representatives John Lewis (D-GA) and Todd Platts (R-PA) for HR 1126—hope that past enthusiasm for such legislation will grow in the current 111th Congress. Although similar Senate bills have passed five times in previous years, the House version of the bill in the 110th Congress had 111 cosponsors. Now that a new Congress is underway, more cosponsors are needed to help advance the bill.

The American Association of Museums has worked with the Association of Art Museum Directors to provide a draft letter that you can use to encourage your federal lawmakers to cosponsor the bill. With your help, this important legislation for both artists and institutions can move forward.

The website of Art in America magazine reports that the Rose Art Museum is not closing this summer as previously expected: “Current exhibitions—‘Saints and Sinners’ and ‘Hans Hofmann: Circa 1950’—will remain on view through May 17th; after a brief de-install, the museum will re-open on July 22nd with works from the permanent collection.” Four museum staff members are expected to retain their positions, although Michael Rush will no longer direct.

Further, according to the museum administrator Jay Knox, Brandeis University plans to dissolve the museum’s board of directors, and the longterm stability of the collection is still unknown.

April 10–12, 2009, is the sixth anniversary of the looting of the National Museum in Baghdad and the subsequent pillaging of archeological sites across Iraq. In the years since 2003, Saving Antiquities for Everyone (SAFE) has held, and has encouraged others to hold, global candlelight vigils in commemoration of the tragic loss suffered by the ransacking of the museum and the looting of artworks and artifacts there—many of which are still missing despite the recent reopening of seven museum galleries.

In New York, a gathering is taking place on April 11, 6:00–7:30 PM, in Washington Square Park. For those living in or near New York, please join the vigil. Donny George, former director of the Iraq Museum, is scheduled to speak.

Elsewhere in the United States, lectures, discussions, and SAFE-related vigils are being held at institutions in Fairbanks, Alaska; St. Paul, Minnesota; Eugene, Oregon; Ceres, California; and Amherst, Massachusetts.
